Breeding Agreement
ALL SALES ARE FINAL AND THE PURCHASE OF AN ANIMAL IS ACCEPTANCE OF THE ABOVE TERMS AND CONDITIONS.
This “Agreement” between you (“You”) and Smart Reptile Creations LLC (“Company,” “We,” or “Us”) governs the policies and rights by which You use MorphMarket.com, (the “Website”). By purchasing a product from the Website, you agree to be bound by and abide by this Agreement.
SHIPPING
LIVE ARRIVAL GUARANTEE: All animals are guaranteed to arrive alive (the “Alive Arrival Guarantee” and to remain alive for the first four hours of confirmed delivery (through FedEx). We reserve the right to request confirmation of the time of death if such does occur. This is best accomplished through a time-stamped video of the animal.
SHIPPING: All shipments will be in accordance with Ship Your Reptiles (SYR) guidelines and FedEx rules and regulations. If you are unfamiliar, please read their respective guidelines/rules/regulations. An agreement to purchase an animal confirms your full understanding and acceptance of SYR’s guidelines. Shipment to the nearest FedEx hub will be the default shipping method unless You agree to accept the nullification of the Live Arrival Guarantee.
Policies
PAYMENT: All sales are FINAL. All payments will be made through money forwarding services such as PayPal Friends and Family, Venmo, or Cash App. Other payment methods will be considered on a case-by-case basis. Due to the potential for scamming activities, a PayPal business transaction will not be considered even with the added 3% fee; please do not ask.
DEPOSITS: Animals can be reserved for a period of fourteen (14) days for a non-refundable deposit of 25% the purchase price of the Animal. This deposit is NON-REFUNDABLE.
PAYMENT PLANS: Animals with a purchase price greater than $500 can be paid for in multiple installments, if the entire purchase price is paid within thirty (30) days of the first payment. Animals with a purchase price greater than $1,000 can be paid for in multiple installments, if the entire purchase price is paid within sixty (60) days of the first payment. Animals being purchased on an installment plan will not be sold otherwise unless You do not make the next installment payment within fourteen (14) days of your last installment payment. ALL INSTALLMENT PAYMENTS ARE NON-REFUNDABLE.
YOUR RESPONSIBILITIES TO THE ANIMAL
We treat all animals with respect and care; giving them a safe, clean and friendly environment. We do not sell to those who do not do the same. You agree to care for any animal you purchase from us in a proper manner.
GUARANTEES
WORLD CLASS SERVICE: We make every reasonable effort to provide the world-class pets, products, service, and advice but We make no guarantees in addition to those contained in this Agreement. This Agreement sets forth the entire agreement between You and US and superseded all other representations, understandings or agreements. WE MAKE NO AND DISCLAIM ALL REPRESENTATIONS NOT EXPRESSLY INCLUDED IN THIS AGREEMENT. All animals are sexed and genetics verified to the best of Our ability only and we make no representations or guarantees otherwise.
Liability Release
We are not responsible for any sickness, injury, or death that could occur to an animal, another animal or a person once an animal leaves Our care. You agree to indemnify and hold harmless Us and Our respective directors, owners, agents, employees, and permitted successors and assigns against any and all claims, losses, damages, liabilities, penalties, punitive damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever.
ALL SALES ARE FINAL AND THE PURCHASE OF AN ANIMAL IS ACCEPTANCE OF THE ABOVE TERMS AND CONDITIONS.
MorphMarket's Default Store Policy
specifies any terms which have not been overridden by this Seller's stated policy.
